Circuit Court of Cook County
Case No. 2017-CH-08092

Welcome to the Settlement Website for the Doporcyk v. Roundy’s Supermarkets, Inc., et al. Class Action Settlement.

YOU MAY BE ENTITLED TO A CASH PAYMENT FROM A CLASS ACTION SETTLEMENT IF YOU PROVIDED YOUR FINGER SCAN FOR EMPLOYEE TIMEKEEPING AT MARIANO’S AT ANY TIME BETWEEN JUNE 9, 2012, TO AUGUST 26, 2021.

  • This is a court-authorized notice of a proposed Settlement in a class action lawsuit, Doporcyk v. Roundy’s Supermarkets, Inc., et al, Case No. 2017-CH-08092, pending in the Circuit Court of Cook County. The Settlement would resolve a lawsuit brought on behalf of persons who allege that Roundy’s Supermarkets, Inc., Roundy’s Illinois LLC d/b/a Mariano’s, and The Kroger Co., (collectively referred to as “Defendants”) required workers at Mariano’s stores in the state of Illinois to provide their biometric identifiers and/or biometric information for timekeeping without first providing them with legally required written disclosures and obtaining written consent, in violation of the Illinois Biometric Information Privacy Act (“BIPA”). Defendants contest these claims and deny that they violated BIPA. If you received this Notice, you have been identified as a member of the Settlement Class.
  • The Court has granted preliminary approval of the Settlement and has conditionally certified the Settlement Class for purposes of Settlement only. The Notice explains the nature of the class action lawsuit, the terms of the Settlement, and the legal rights and obligations of the Settlement Class Members. Please read the instructions and explanations in the Notice so that you can better understand your legal rights.
